Terms and Conditions

These Terms and Conditions govern the use of the JobsHype website, platform and services.

By accessing the JobsHype platform, creating an account, placing an order, launching a campaign or otherwise using our services, you agree to be bound by these Terms.

If you do not agree to these Terms, you should not use JobsHype or our services.

References in these Terms to "JobsHype", "Jobs Hype", "we", "our" or "us" refer to Talent Acquisition Group Limited.

References to "client", "you" or "your" refer to the organisation or individual purchasing, accessing or using our services.

A "candidate" means an individual who applies for, expresses interest in, engages with, or is considered for an employment opportunity through or in connection with JobsHype.

Our Services

JobsHype provides recruitment marketing, recruitment technology, candidate engagement and recruitment intelligence services designed to help employers attract, engage, screen and communicate with candidates.

Our services may include:

  • Recruitment campaign creation and management
  • Social media recruitment advertising
  • Audience targeting and distribution
  • WhatsApp Apply and conversational application experiences
  • Candidate application and screening tools
  • AI-assisted candidate screening and recruitment decision support
  • Candidate messaging and communication tools
  • Talent pool creation and management
  • Candidate re-engagement
  • Recruitment campaign boosting
  • Creative content production
  • Recruitment marketing consultancy
  • Campaign reporting and analytics
  • Recruitment intelligence and recommendations
  • AI-assisted content generation and optimisation
  • Access to JobsHype platforms, dashboards and related technology

The precise services available may vary according to the product, campaign, subscription or service purchased.

JobsHype provides recruitment technology and recruitment marketing services. We are not the employer and do not make the client's final recruitment, selection or hiring decisions.

3.

Client Responsibilities

Clients are responsible for ensuring that:

  • Information supplied to JobsHype is accurate, complete and not misleading
  • Vacancies and employment opportunities promoted through JobsHype are genuine
  • They have the necessary authority to advertise and recruit for the roles submitted
  • Job descriptions, pay information, working arrangements and other vacancy information are accurate
  • Recruitment activity complies with applicable employment, equality, anti-discrimination, data protection and other relevant laws
  • Candidate information is used lawfully and for legitimate recruitment purposes
  • Communications with candidates are professional, appropriate and relevant to recruitment
  • Appropriate human oversight is applied to recruitment and hiring decisions
  • Employees, recruiters and other authorised users accessing JobsHype on their behalf comply with these Terms

Clients remain responsible for their recruitment processes, their treatment of candidates, communications made to candidates and their final hiring decisions.

4.

Recruitment Campaigns and Content

JobsHype may assist clients in producing recruitment advertisements, job content, campaign creative, application journeys and other recruitment materials.

Clients remain responsible for reviewing and approving information supplied by them or published on their behalf, including:

  • Vacancy information
  • Job descriptions
  • Salaries and benefits
  • Employment terms
  • Recruitment advertisements
  • Campaign content
  • Images and creative assets
  • Statements or representations concerning the employer or employment opportunity

JobsHype may provide recommendations or generate content using automated or AI-assisted tools. Clients remain responsible for ensuring that information relating to their organisation and vacancies is accurate.

We reserve the right to refuse, edit, pause, reject or remove content or campaigns where we reasonably believe they are misleading, inappropriate, unlawful, discriminatory, contrary to these Terms or contrary to the requirements of a third-party platform.

5.

Social Media Advertising and Third-Party Platforms

JobsHype may deliver recruitment campaigns through third-party advertising, social media and technology platforms, including Meta platforms such as Facebook and Instagram.

Campaigns must comply with applicable advertising standards and the policies imposed by the platforms through which they are distributed, including policies applying specifically to employment advertising.

Clients must not provide content, targeting instructions or other information which would cause a campaign to breach applicable law or third-party advertising policies.

JobsHype may modify, reject, pause or remove advertising where we reasonably believe it may breach:

  • Applicable law or regulation
  • Advertising standards
  • Meta or other third-party platform policies
  • Employment advertising requirements
  • These Terms

Third-party platforms retain control over approval, distribution and continued availability of advertising placed on their services.

JobsHype therefore cannot guarantee that an advertisement will be accepted or remain approved by a third-party platform.

Campaign performance may also be affected by circumstances outside our control, including platform policy changes, advertising competition, audience availability, algorithm changes, technical outages and changes made by third-party providers.

Unless expressly agreed otherwise in writing, JobsHype does not guarantee a particular number of applications, candidates, interviews, hires, impressions, clicks or other campaign results.

6.

WhatsApp and Candidate Communications

JobsHype may provide functionality enabling clients to communicate with candidates through WhatsApp and other messaging or communication channels.

This may include:

  • Conversational applications
  • Application and screening conversations
  • Recruiter-to-candidate messaging
  • Candidate updates
  • Interview or meeting communications
  • Talent pool communications
  • Candidate re-engagement
  • Notifications about relevant employment opportunities

Where a client creates, initiates, approves or sends a communication using JobsHype, the client is responsible for the content, purpose, accuracy and appropriateness of that communication.

Clients must not use JobsHype messaging functionality to send content which is:

  • Unlawful
  • False or misleading
  • Discriminatory
  • Threatening, abusive, offensive or harassing
  • Unrelated to legitimate recruitment activity
  • Unsolicited commercial advertising
  • Intended primarily to sell products or services to candidates
  • Spam or excessive messaging
  • Contrary to applicable privacy or electronic communications legislation
  • Contrary to WhatsApp, Meta or another applicable third-party platform's policies

JobsHype provides technology through which communications may be facilitated or delivered. Except where responsibility cannot lawfully be excluded, JobsHype is not responsible for statements, representations, promises, employment offers or other communications created or made by a client.

Clients must respect candidate communication preferences and must not deliberately circumvent opt-outs, suppression controls or other restrictions applied by JobsHype or a messaging provider.

JobsHype may restrict, suspend or remove messaging functionality where we reasonably believe it is being misused or where continued use could jeopardise JobsHype's messaging infrastructure, third-party accounts, candidates or other users.

7.

Candidate Data and Permitted Use

Candidate information made available through JobsHype is provided for recruitment purposes.

Subject to applicable data protection law and any relevant candidate preferences, clients may use candidate information to:

  • Assess a candidate for a vacancy for which they have applied or expressed interest
  • Communicate with candidates about their application or employment opportunity
  • Consider candidates for other genuinely relevant employment opportunities
  • Maintain legitimate recruitment talent pools
  • Re-engage candidates about appropriate employment opportunities
  • Undertake related recruitment and hiring activities

Candidate information obtained through JobsHype must not be used to create consumer marketing databases, sales databases or commercial prospecting lists.

Clients must not:

  • Sell candidate information
  • Rent candidate information
  • Trade or commercially distribute candidate information
  • Provide candidate information to third parties for unrelated marketing purposes
  • Use candidate information primarily to advertise or sell unrelated products or services
  • Harvest or systematically extract candidate information for unrelated purposes
  • Use JobsHype as a means of building a database for non-recruitment commercial activity

Clients must have an appropriate lawful basis for their processing of candidate information and are responsible for any privacy information, retention arrangements or other obligations applicable to their own processing activities.

Where candidate information is retained within a talent pool, it must continue to be used for legitimate recruitment purposes and handled in accordance with applicable data protection law.

JobsHype may restrict access to candidate information, remove data access or suspend or terminate an account where we reasonably believe candidate information is being misused.

8.

Talent Pools and Candidate Re-engagement

JobsHype may enable clients to build and maintain talent pools containing candidates generated through recruitment campaigns, applications and other recruitment activity.

Talent pools are intended to enable legitimate future recruitment activity and should not be treated as general-purpose marketing databases.

The presence of a candidate in a talent pool does not guarantee that:

  • The candidate remains available
  • The candidate remains interested in employment
  • The candidate is suitable for a future vacancy
  • Contact details remain accurate
  • The candidate will respond to future communications

Clients remain responsible for deciding whether contacting a candidate about a future opportunity is appropriate and lawful.

Where JobsHype provides candidate re-engagement or audience activation functionality, clients must use it only for legitimate recruitment opportunities and in accordance with candidate preferences and applicable law.

9.

AI and Automated Recruitment Tools

JobsHype may use artificial intelligence, automation and other technologies to assist with:

  • Candidate applications
  • Candidate screening
  • Assessment against vacancy requirements
  • Recruitment decision support
  • Content generation
  • Audience analysis
  • Campaign recommendations
  • Recruitment intelligence
  • Reporting
  • Campaign optimisation

AI-assisted screening is intended to help process candidate information and support recruitment activity. It does not replace the client's responsibility for its recruitment process or final hiring decisions.

Clients should apply appropriate human oversight to recruitment decisions and should not rely solely on automated output where doing so would be inappropriate or unlawful.

AI-generated content, recommendations and assessments may contain errors or require interpretation. Clients remain responsible for decisions made using information provided through the platform.

10.

Candidate Information and Accuracy

Candidate information may be supplied directly by candidates, generated through an application process, obtained from information provided during recruitment conversations or processed using JobsHype technology.

JobsHype does not independently guarantee the accuracy, completeness or authenticity of all information supplied by candidates.

Clients remain responsible for carrying out any checks reasonably required before making employment decisions, which may include identity, qualifications, references, right-to-work, professional registration, criminal-record or other appropriate checks.

11.

Fees and Payment

Where services are provided on a paid basis, applicable fees will be displayed through the platform, agreed in writing or otherwise communicated before purchase.

Depending on the service, payment may be made through online payment, invoice, enterprise billing account or another agreed method.

Clients agree to pay charges incurred through authorised use of their account.

Where enterprise billing arrangements apply, charges may be added to the client's account and invoiced in accordance with the agreed billing arrangements, credit limits, purchase-order requirements and payment terms.

Late or overdue payments may result in suspension or restriction of services.

Unless otherwise stated or agreed in writing, fees are non-refundable once campaign delivery, advertising activity, candidate engagement or another purchased service has commenced.

12.

Campaign Performance

Recruitment campaign performance varies according to factors including:

  • Vacancy type
  • Location
  • Salary and benefits
  • Employer proposition
  • Candidate availability
  • Advertising competition
  • Market conditions
  • Campaign budget
  • Third-party advertising algorithms
  • Candidate behaviour

Past campaign performance, case studies, examples or indicative results do not guarantee future results.

Candidates remain independent individuals and JobsHype cannot guarantee that a candidate will respond, attend an interview, accept employment or remain in a role.

13.

Platform Availability and Third-Party Services

We aim to provide reliable access to JobsHype but do not guarantee uninterrupted or error-free availability.

Services may occasionally be unavailable or affected by:

  • Planned maintenance
  • Technical issues
  • Internet or telecommunications failures
  • Third-party outages
  • Meta or WhatsApp availability
  • Payment provider availability
  • Changes to third-party APIs or services
  • Circumstances beyond our reasonable control

JobsHype may depend on third-party technology providers to deliver parts of the service. We are not responsible for the availability or actions of those providers where these are outside our reasonable control.

14.

Intellectual Property

JobsHype branding, software, technology, platform functionality, website design and proprietary content remain the property of Talent Acquisition Group Limited or its licensors.

Clients must not, except where permitted by law or expressly authorised by us:

  • Copy or reproduce JobsHype software or proprietary functionality
  • Reverse engineer or attempt to extract source code
  • Reproduce JobsHype branding without permission
  • Resell access to the platform
  • Redistribute proprietary JobsHype content
  • Use JobsHype intellectual property in a way which falsely suggests endorsement or affiliation

Where custom campaign assets are created for a client, ownership and usage rights may be governed by the applicable service agreement or order.

Clients confirm that they have appropriate rights to any logos, images, trademarks, text or other materials supplied to JobsHype for use in campaigns.

15.

Acceptable Use

Users must not:

  • Submit false or misleading information
  • Advertise unlawful, misleading or non-genuine employment opportunities
  • Use JobsHype for unlawful or discriminatory purposes
  • Send spam, abusive, misleading or inappropriate communications
  • Use candidate information for unrelated commercial marketing
  • Sell, rent, trade or commercially distribute candidate information
  • Scrape, harvest or systematically extract candidate data without authorisation
  • Circumvent candidate opt-outs or suppression controls
  • Impersonate another person or organisation
  • Attempt unauthorised access to systems, accounts or data
  • Distribute malware or harmful content
  • Interfere with the operation or security of JobsHype
  • Use automated systems to access or extract information in an unauthorised manner
  • Use JobsHype in a way which could cause JobsHype's advertising, WhatsApp, Meta or other third-party accounts or infrastructure to breach applicable policies

JobsHype reserves the right to reject, edit, pause, remove or disable content, advertisements, campaigns, communications or access where we reasonably believe these Terms have been breached.

Serious or repeated misuse may result in suspension or termination of the client's account or services.

16.

Moderation and Removal of Content

JobsHype is not obliged to publish or continue distributing any campaign, advertisement, vacancy, message or other content.

We reserve the right to remove, pause, modify or refuse content where reasonably necessary to:

  • Comply with law or regulation
  • Comply with third-party platform policies
  • Protect candidates or other users
  • Protect JobsHype's reputation, technology or third-party accounts
  • Investigate suspected misuse
  • Address inaccurate or misleading information
  • Enforce these Terms

Where reasonably practicable, we may contact the client concerning material that requires amendment, but we are not required to do so before taking action where immediate removal or suspension is appropriate.

17.

Accounts and Security

Clients are responsible for maintaining the security of their accounts and for activity carried out by authorised users of their organisation.

Login details must not be shared with unauthorised persons.

Clients should notify JobsHype promptly if they believe their account or candidate information has been accessed without authorisation.

We may suspend access where we reasonably believe an account has been compromised or presents a security risk.

18.

Privacy and Data Protection

JobsHype processes personal information in accordance with applicable data protection legislation.

Further information about how JobsHype processes personal information is provided in our Privacy Policy.

Clients using candidate information through JobsHype are responsible for complying with the data protection obligations that apply to their own processing of that information.

Depending on the particular service and processing activity, the respective data protection roles and responsibilities of JobsHype and the client may differ. Where necessary, these may be further described in a separate data processing agreement or service agreement.

Use of JobsHype does not remove or replace a client's own responsibilities under applicable data protection law.

19.

Suspension and Termination

JobsHype may suspend, restrict or terminate access to some or all services where:

  • These Terms are materially or repeatedly breached
  • Candidate information is misused
  • Messaging functionality is abused
  • Unlawful or discriminatory recruitment activity occurs
  • Required fees remain unpaid
  • Activity threatens the security or integrity of the platform
  • Activity risks suspension or restriction of JobsHype's third-party accounts
  • Continued provision would breach applicable law or third-party requirements
  • Fraudulent or abusive activity is reasonably suspected

Termination or suspension does not remove a client's obligation to pay charges already incurred.

20.

Limitation of Liability

JobsHype provides recruitment marketing, recruitment technology and candidate engagement services.

To the fullest extent permitted by law, JobsHype does not guarantee:

  • Candidate applications
  • Candidate suitability or quality
  • Candidate availability
  • Candidate responses
  • Interview attendance
  • Successful hires
  • Employee retention
  • Particular advertising performance
  • Particular recruitment outcomes

To the fullest extent permitted by law, JobsHype shall not be liable for:

  • Indirect or consequential losses
  • Loss of revenue, profits, business or opportunity
  • Business interruption
  • Recruitment, employment or hiring decisions made by clients
  • Information supplied by candidates or clients
  • Communications, representations or commitments made by clients to candidates
  • A client's use or misuse of candidate information
  • Content supplied, approved or sent by a client
  • Actions taken by candidates
  • Rejection, suspension or removal of advertising by third-party platforms
  • Third-party platform outages or restrictions outside our reasonable control

Nothing in these Terms excludes or limits liability where such liability cannot lawfully be excluded or limited.

21.

Indemnity

To the extent permitted by law, the client shall be responsible for losses, claims, liabilities, costs or expenses reasonably incurred by JobsHype arising directly from the client's:

  • Unlawful use of the platform
  • Material breach of these Terms
  • Misuse of candidate information
  • Unlawful or unauthorised candidate communications
  • Infringement of third-party intellectual property rights through materials supplied by the client
  • Recruitment activity that breaches applicable law

This provision does not apply to the extent that the relevant loss or liability results from JobsHype's own breach, negligence or other responsibility which cannot lawfully be excluded.

22.

Changes to Services

JobsHype is an evolving technology platform.

We may introduce, modify, replace or discontinue features where reasonably necessary to develop the service, respond to technical requirements, comply with law or third-party policies, or improve platform operation.

Where a material change significantly affects a paid service already purchased, we will take reasonable steps to minimise disruption.

23.

Changes to These Terms

We may update these Terms from time to time to reflect changes to our services, technology, legal obligations or business operations.

Updated Terms will be published on the JobsHype website with an updated revision date.

Where appropriate, we may notify registered users of material changes.

Continued use of JobsHype following the effective date of updated Terms constitutes acceptance of those Terms.

24.

Governing Law and Jurisdiction

These Terms and any dispute or claim arising from them are governed by the laws of England and Wales.

The courts of England and Wales shall have exclusive jurisdiction in relation to disputes arising from or connected with these Terms, subject to any rights which cannot lawfully be restricted.
